Terms of Service

These terms are the agreement between you and NovaPath for use of the NovaPath Coach iPhone app. By installing and using it you accept them. If you do not accept them, do not use NovaPath Coach.

NovaPath Coach runs entirely on your device. There is no account to create and no server holding your content.

NovaPath Coach is coaching, not healthcare

NovaPath Coach is a self-development and mental fitness tool. It is not a medical device, not a healthcare service, and not a substitute for diagnosis, treatment, therapy, or advice from a licensed professional. The coach is an AI system running on your device. It does not diagnose conditions, does not prescribe anything, and can be wrong — an on-device model is smaller than a cloud one, so expect shorter and blunter replies. Nothing it says is medical, psychological, legal, or financial advice.

If you are in crisis or thinking about harming yourself or someone else, do not use this app for help. Contact your local emergency number. In the US, call or text 988 for the Suicide & Crisis Lifeline.

Using the app

  • You must be 17 or older to use NovaPath Coach.
  • There is no account and no password. Anyone who can unlock your iPhone can open the app unless you turn on the Face ID lock in Settings.
  • Your content lives only on this device. It is not synced, and it is not accessible from another phone or from the web.
  • You can delete everything at any time in Settings. It is immediate and permanent.
  • Deleting the app deletes its data with it.

Your content

Everything you write in NovaPath Coach stays yours, and it stays on your device. We are granted no licence to it, because we never receive it: there is no server to store it on and no AI provider it is sent to. We cannot publish it, sell it, or train anything on it.

The corollary is that keeping it safe is yours too. We have no copy, so if you lose the device, or delete the app, with iCloud backup switched off, the content is gone and we cannot recover it.

Subscriptions

NovaPath Coach offers an optional auto-renewing subscription, purchased through the App Store.

  • Payment is charged to your Apple Account at confirmation of purchase.
  • The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your Apple Account is charged for renewal within 24 hours prior to the end of the current period, at the price shown at purchase.
  • You can manage or cancel your subscription in Settings → Apple Account → Subscriptions, or from within the app.
  • Prices and available terms are shown in the app before you purchase, and may vary by region.

Refunds are handled by Apple under the App Store Terms of Service; we cannot issue them ourselves.

Acceptable use

You agree not to:

  • Use NovaPath Coach for anything illegal, or to harass or harm anyone.
  • Reverse-engineer the app, or redistribute or resell it.
  • Remove or obscure the notices in the app about what it is and is not.

There is no account for us to suspend. Breaking these terms ends your licence to use the app.

Availability and changes

The app runs on your device, so it keeps working whether or not we do. We may add, change, or remove features in future versions, and we are not obliged to keep publishing updates. If we stop developing NovaPath Coach, the copy on your iPhone continues to work and your data stays where it is.

Disclaimers and liability

NovaPath Coach is provided “as is” and “as available”, without warranties of any kind to the fullest extent the law allows. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data. Where liability cannot be excluded, our total liability is limited to the greater of the amount you paid us in the previous twelve months or US$50. Nothing here limits liability that cannot be limited by law, including for fraud, death, or personal injury caused by negligence.

iOS end user licence

The following applies to the NovaPath Coach app obtained from the Apple App Store:

  • This agreement is between you and NovaPath only, not Apple. Apple is not responsible for the app or its content.
  • You are granted a non-transferable licence to use the app on any Apple-branded device you own or control, as permitted by the App Store Terms of Service.
  • NovaPath — not Apple — is solely responsible for maintenance and support. Apple has no obligation to provide either.
  • If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever.
  • NovaPath — not Apple — is responsible for any claim that the app or your use of it fails to conform to any legal requirement, arises under product liability, or arises under consumer protection or similar law.
  • NovaPath — not Apple — is responsible for the investigation, defence, settlement, and discharge of any third-party claim that the app infringes intellectual property rights.
  • You represent that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
  • You must comply with any applicable third-party terms of agreement when using the app.
  • Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce its terms against you.
